RECOMMENDATION: That the Board of Directors go into a closed session, as provided
in Iowa Code Section 21.5(1)(a), to review or discuss records which are required or
authorized by state or federal law to be kept confidential or to be kept confidential as a
condition for the possession or continued receipt of federal funds; and, as provided in
Iowa Code Section 25.5(1)(c), to discuss strategy with counsel in matters that are
presently in litigation or where litigation is imminent where its disclosure would be likely to
prejudice or disadvantage the position of the governmental body in that litigation.
